Placing an order

When placing an order it will be deemed you have read, understood and agreed to these Terms and Conditions as set forth by Chia Maria. Should you be uncertain over any of our terms and conditions please contact us before placing an order. You can telephone us on 020 8265 4539, send an email to sales@chiamaria.com or by post to our address in Suffolk.

By using our website to place an order it is considered that you are making an offer to purchase Chia Maria branded goods as per your order and according to the terms as described in your order.

Upon placing your order, we will then send you a confirmation that your order has been received by Chia Maria, but this is not a confirmation from us that your offer to purchase the goods has been accepted. A contract between you and Chia Maria for the sale of our products shall only exist once an order has been accepted, processed and dispatched by us to you. We shall authorise your credit/debit card once your order is placed and processed by us. However, you will not be charged for the value of the goods you wish to purchase until at the point they are dispatched to you and your nominated postal address. This does not affect your statutory rights.

All prices and availability of goods as indicated on the Chia Maria website and all other forms of promotions and advertising are subject to change without prior notice. A delivery charge for postage and packaging will be added to your order value where appropriate. Please see the section below detailing our postage & packaging charges.

All delivery dates quoted to you are estimated delivery dates only and these may be subject to change. We accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery. All orders received and accepted before 3pm shall, subject to availability and where possible, be dispatched on the following working day via our next day courier delivery service. We reserve the right to select the means and terms with the postal/courier companies with whom we work with to deliver an order. For those orders received and accepted after 3pm, these shall be deemed as received the following working day and will be dispatched the day after.

Postage and packaging

Within UK

Via our dedicated courier service:

• Standard service - £4.95 per shipment. Delivered within 3-5 working days.
• Next day service for orders placed before midday - £9.95 per shipment.
• Saturday deliveries - please enquire.
• Orders over £100 are with free post and packaging via our Standard service.
• Goods paid for by cheque will be dispatched within 24 hours of cheque clearance.

Please note that Chia Maria is not responsible nor liable for any costs or damages you may incur for any damaged goods, delays or non-delivery whatsoever related to the postal/courier services we select to deliver your goods. In such instances, we shall endeavour to rectify the postal/courier issue to your satisfaction as soon as possible upon your notifying us.

Stock availability

We aim to hold stock of all products whilst a product is current. Products that are in production, out of stock or to be launched shall be indicated on the Chia Maria website along side the corresponding product. Errors and omissions excepted. We shall endeavour to advise you as accurately as possible on stock availability for those items that, for whatever reasons, are not in stock.

Conformity of goods

We take pride of care to ensure that the description and specification of all our products are correct at the time of being uploaded to our website and when going to press. However, all specifications and descriptions of products on this website are not intended to be binding. They are intended only to give a general description of the products. Additionally, whilst colour reproduction of the products as seen on the website is set as close as possible to actual representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer systems as used to view Chia Maria products.

Your right to cancel

You have the right to cancel your order in writing or by email within 10 days of receipt of the goods and receive a refund from Chia Maria. This refund shall be less the postage and packaging you paid to send the goods to you in the first instance. You will then need to return the item(s) by post. Parcels returned to us by post or by other means you select are returned at your own cost.

You have the right to cancel your order in writing or by email before we have dispatched your order. We will make a complete refund of the charges for goods along with any postage and packaging you may have paid to Chia Maria.

Returns and exchanges policy

Returns. If you are not satisfied for whatever reason with the products that you have chosen and received, then you may return them to us within 10 days of receipt. We will be happy to offer you an exchange to the same value or higher. Products are to be returned complete, in perfect condition, unused, unwashed and with the original packaging. We will refund the value of goods purchased less the postage and packaging charge you paid to receive the goods in the first instance. Exchange. For an exchange, if the product you require is available we will exchange it for you. Postage and packaging will be charged on exchanges we send to you. If the product costs more than the one you have returned we will need to take an additional payment from you before we can send you the product. We reserve the right to not refund the difference if the product is lower in value. We will exchange the value of goods purchased less the postage and packaging charge you paid to receive the goods in the first instance.

Faults. Items can be returned if you have identified a fault within 30 days of purchase and notified us so. We can discuss the fault with you and agree the best way forward. But please do take extra care to follow carefully all recommended wash/care instructions or any specific care instructions provided with your purchase. We cannot accept an item returned as faulty if the appropriate product care instructions have not been followed and the damage caused to the product is clearly due to wear and tear or misuse. We will pay for the cost of return provided we have agreed beforehand the means of return.

Unwanted gift. An item that was received as a gift can be returned by your notifying us within 10 days of receipt for an exchange or for a gift voucher(s) for the same value. For values above the goods value as paid at time of purchase, you will need to pay the difference.

Parcels returned to us by way of any of the abovementioned return, exchange or unwanted gift are returned at your own postage and packaging cost, except for faulty items. We are not able to refund any postage and packaging charges. We strongly recommend you obtain a free certificate of postage from the Post Office as we are responsible for your parcel only once it has been received into our warehouse and provided you have notified us by post or email of the abovementioned return, exchange or unwanted gift within 10 days of receipt. Items lost in transit will not be treated as returned.

We can also arrange for our courier company to collect the parcel from your preferred collection address. You, or your nominated person, will need to be at the preferred address to hand over the parcel. There is a charge for this service. There is no charge should we use our courier to collect faulty items from you.

Gift vouchers

Gift vouchers can be exchanged for goods via the Chia Maria website or by phone on 020 8265 4539. Gift vouchers cannot be exchanged or refunded for cash. Gift vouchers may be used towards the purchase of goods at a higher price than the face value of the voucher upon payment of the difference. Chia Maria is under no liability for replacement or refund should vouchers be lost, stolen, damaged or destroyed whether they have been redeemed or not. The paper value of Chia Maria gift vouchers is £0.001. Furthermore, we reserve the right to refuse any vouchers that have been modified, damaged or defaced. Gift vouchers are only valid with a unique serial number.

Prices

All prices quoted on this website are accurate at the time of publication. They are quoted in British pounds sterling and are inclusive of UK sales tax (VAT) at the current rate. If your order is being dispatched to a destination outside of the European Union (EU) then your sales tax will be zero. If your order is being sent to a member state of the EU then the selling price will include UK VAT. You will be responsible for the payment of any customs or import duties levied once the package reaches your destination country.

Payment security

If your credit/debit card is used fraudulently as a direct result of being used to buy from the Chia Maria website, we will assume liability for only the first £50 of your loss. Please liase with your credit card company and their obligation to take responsibility for the rest. We will use reasonable endeavours to work with your credit card company to minimise the inconvenience for you.

Intellectual property

The contents of these pages (including pictures, designs, logos, photographs, text written and other materials) are the copyright/registered trademark of Chia Maria or its content and technology providers or their respective owners. ALL RIGHTS RESERVED. The copying, reproduction, modification, distribution or incorporation into any other work or project of part or all of the material available on this website in any form is prohibited.

You may however copy, print (one copy only) or download extracts of the material on the Chia Maria website for the sole purpose of using this website in good faith for domestic purposes or for placing an order with Chia Maria.

You may also copy print (one copy only) or download the material on this website for the purpose of sending to individual third parties for their personal information provided that you do seek no commercial advantage or benefit from so doing. Also, when doing so, you acknowledge us as the source of the material and you take note to inform such third party that these conditions apply to them and that they be complied to.

Disclaimer & limitations of liability

Chia Maria does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, neither Chia Maria nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Chia Maria or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of the Chia Maria website, the supply of the goods or their use or resale by you.

The limitations of liability in these conditions shall apply equally for the benefit of Chia Maria.

Whilst Chia Maria uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not provide any warranty whatsoever as to its accuracy or completeness. Chia Maria will not be held responsible for any errors or omissions or for the results arising from the use of such information. Whilst Chia Maria takes all reasonable steps to ensure a reliable service, it does not guarantee that your use of the Chia Maria website shall be free of errors or interruptions. Chia Maria will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Further, Chia Maria will not be responsible nor liable for your use of any other websites which you may access via links within this website. Chia Maria does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Chia Maria. The entire liability of Chia Maria under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.

Chia Maria will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

Chia Maria may assign or transfer any of its rights or sub contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Chia Maria.

No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

Law and territory

These Terms and Conditions and your use of the Chia Maria website are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. The website and these Terms and Conditions have been designed for use within the United Kingdom and under UK law. We are happy to consider requests for products and enquiries from outside the United Kingdom, but we provide no warranty, express or implied, that the use of the website or the placing of any order through the website from outside the UK complies with any applicable non-UK laws or regulations. Any products or promotions not permitted under your local law are not offered to you.
